Serious and Catastrophic Injuries

When an accident results in particularly grievous harm, such as traumatic brain injury (TBI) or spinal cord injury (SCI), the results can be devastating.  The costs of medical care for these injuries can be exorbitant, often lasting a lifetime and requiring extensive rehabilitation, to say nothing of the emotional toll taken by life-changing harm of this nature.  With an extensive background in a variety of health care-related fields, firm associate Marilyn Dymer is familiar with the complex medical and legal issues that come into play in these serious cases, and can provide the counsel you need to ensure the full extent of your needs are accounted for.

Wrongful Death

If a tragic incident caused by another person or entity has led to the loss of someone you love, as a surviving family member you may want to consider filing a suit for wrongful death.  In a wrongful death claim, recovery is intended to compensate you for the damages you personally sustained due to the loss of the deceased.  Such recovery may include economic damages such as loss of support provided by the deceased or funeral expenses, or non-economic damages such as grief or loss of consortium.  Depending on whether you are located in Kansas or Missouri, statutes vary as to the type and amount of recovery that is available to compensate you for your losses.  Our attorneys can advise you on these and other issues related to your representation.

Workers' Compensation

Every day, many of us face dangerous or hazardous conditions in the workplace.  While safety precautions should be in place to reduce the likelihood that harm will come to you, accidents sometimes cannot be avoided.  Workers' compensation is a form of insurance intended to compensate for medical expenses incurred due to work-related injuries or illnesses.  Depending on the jurisdiction in which you work, you may be eligible for compensation covering for a range of losses, including medical expenses or disability benefits, which address the loss in wages that resulted from your injury.  It is important to remember, however, that workers' compensation does not cover pain and suffering and other non-economic damages typically sought in a personal injury lawsuit.

  • Third Party Liability

In the event that your workplace injury occurred in part because of a dangerous or potentially defective component part or piece of equipment, you may also be eligible to file a personal injury lawsuit under a theory of "third party liability."  Any recovery obtained through settlement or litigation against this third party - be it the equipment manufacturer or another entity - is in addition to the coverage provided under your state's workers' compensation laws.

Motor Vehicle Accidents

Accidents occurring on the roads and highways are typically the most common source of personal injury lawsuits, whether arising due to automobile, motorcycle, or trucking accidents.  Each of these accidents presents its own challenges, both in terms of the extent of care needed and the potential sources of recovery.  While in many automobile crashes you will be dealing directly with an insurance company, trucking accidents may potentially involve multiple liable parties, from the truck driver to the company that employs him or her.  Due to their unprotected nature, motorcycle crashes can be particularly devastating, often resulting in serious or catastrophic injuries.  For a free consultation to find out how we can provide the representation you need in connection with your motor vehicle accident, contact Daniel J.
